These Terms & Conditions (“Terms”) govern your access to and use of the website and services provided by Beachside Dog Training, (“we,” “us,” “our”). By visiting the site, booking a consult, enrolling, or participating in any training, you agree to these Terms.

1) Services

We provide dog training services, including Private Training, In-Home Training, Group Classes, Board & Train, Online Training, and Puppy Pre-School (“Services”). Program details (goals, cadence, location) are disclosed during consult and enrollment.

2) Eligibility

You must be 18+ and legally able to enter contracts. You are responsible for fees and compliance with these Terms. Information you provide must be accurate and complete.

3) Enrollment & Accounts

To enroll, complete required forms, accept applicable policies, and pay any stated deposit. Keep your contact details current. We may decline or discontinue service where safety, welfare, or policy violations exist.

4) Training Philosophy & No Guarantee

We are positive-first, balanced when appropriate, using least-intrusive, most-effective methods with humane standards. Training outcomes vary with genetics, history, environment, and owner compliance. No results are guaranteed.

5) Health, Vaccinations, and Participation

  • Follow your veterinarian’s guidance for age-appropriate vaccination and parasite prevention. Puppies may begin controlled early socialization per vet guidance.
  • Do not attend if your dog shows illness (GI signs, cough, fever, eye/nasal discharge). Notify us to reschedule.
  • Disclose bite history, significant aggression, triggers, and management needs before enrollment. Muzzle conditioning or Private/In-Home may be required before Group.
  • Dogs in heat are not permitted in Group Classes; use Private/In-Home during the cycle.

6) Owner Responsibilities

  • Arrive on time with required gear (6-ft leash, collar/harness, treats, mat; any additional tools as directed).
  • Maintain control of your dog; supervise children; follow trainer instructions.
  • Complete daily homework and management steps between sessions.
  • For In-Home: secure hazards, exits, and provide a clear working area.
  • Respect facility rules and other clients’ space.

7) Safety; Assumption of Risk; Release

Animal training involves inherent risks (scratches, bites, falls, property damage). You assume all risks for yourself, your dog, and persons you bring. To the fullest extent permitted by law, you release and hold harmless Beachside Dog Training, its owners, staff, contractors, and partners (including Splash Premier Pet Resort) from claims arising from participation, except where caused by our gross negligence or willful misconduct.

8) Emergencies & Veterinary Care Authorization

You authorize us to seek reasonable and necessary veterinary care if urgent issues arise during a session, class, or Board & Train stay. You are financially responsible for such care. We will make reasonable efforts to contact you using the information on file.

9) Payments, Deposits, and Refunds

  • Fees and any deposit are disclosed before booking. Deposits may be non-refundable unless stated otherwise.
  • Payment is due as stated at enrollment. We may suspend services for unpaid balances.
  • Refunds: because outcomes depend on living beings and owner compliance, completed services are not refundable. Unused, prepaid sessions may be credited or rescheduled per policy.
  • Taxes, processing fees, and third-party charges may apply where required.

10) Cancellations & Rescheduling

  • Private/In-Home/Online: provide at least 24 hours’ notice to reschedule without penalty. Late cancellations or no-shows may be charged as a used session.
  • Group Classes: your enrollment reserves a seat; missed classes are not refundable. When possible, we provide brief recaps; make-ups are space-permitting.
  • Board & Train: cancellations within 7 days of start may forfeit deposit; early pickups do not guarantee prorations.

11) Board & Train—Specific Terms

  • Daily care: multiple pro sessions, enrichment, decompression, and lifeskills; field trips as appropriate.
  • Owner updates: periodic updates and media as feasible.
  • Gear: labeled food, medications with instructions, and approved equipment.
  • Behavior management: humane management tools and training equipment consistent with plan and welfare.
  • Transfer & maintenance: post-stay transfer lessons are required; maintenance plan provided.
  • Unplanned vet care: handled per Section 8.
  • Abandonment: failure to pick up or arrange care triggers applicable legal procedures.

12) Group Classes—Specific Terms

  • Small class sizes; graduation is based on skill demonstration and attendance.
  • Dogs must be safe to work near others. Reactive or aggressive dogs start in Private/In-Home before Group.
  • Bring required gear; follow instructor directions; respect spacing.
  • Weather/heat contingencies may shift class indoors, reschedule, or move online.

13) Online Sessions

You are responsible for working audio/video and a stable connection. We may record brief clips for your training plan. Do not stage risky scenarios on camera; safety remains your responsibility.

14) Media; Testimonials

We may capture photos/video for your private homework and progress tracking. Public use (site/social) requires your consent. You may withdraw consent prospectively by written notice.

15) Intellectual Property & Website Use

All content, plans, handouts, and materials are our intellectual property or licensed to us. We grant you a limited, non-transferable license for personal, noncommercial use. Do not reproduce, distribute, or resell materials without written permission.

16) Prohibited Conduct

  • Recording/distribution of sessions or classes without permission.
  • Harassment, threats, or disorderly conduct toward staff or clients.
  • Bringing illegal substances or weapons to sessions or classes.
  • Violating facility rules or disrupting classes.

17) Third-Party Services

Payments, scheduling, messaging, and analytics may be provided by third parties subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

18) Disclaimers

Services and site are provided “as is” and “as available.” To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee outcomes.

19) Limitation of Liability

To the fullest extent permitted by law, our total liability for claims arising out of or relating to the Services will not exceed the amount you paid for the Services giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

20) Indemnification

You agree to indemnify and hold Beachside Dog Training, its owners, employees, and contractors harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your negligence or misconduct, including injury or damage caused by your dog.

21) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., severe weather, power failures, labor disputes, public health orders, or acts of government).

22) Changes to Services or Terms

We may update Services and these Terms. Changes are effective when posted with a new “Effective date.” Continued use after changes means you accept the updated Terms.

23) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflicts rules.

Binding Arbitration; Class Action Waiver

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration on an individual basis under the JAMS (or AAA) rules in Orange County, California. Class and representative actions are waived. Judgment on the award may be entered in any court of competent jurisdiction. You and we each waive the right to a jury trial.

24) Severability; No Waiver; Entire Agreement

If any provision is held invalid, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. These Terms, together with enrollment forms, program policies, and our Privacy Policy, are the entire agreement regarding the Services.
